AB 116 (CIVIL TRAFFIC INFRACTIONS) EXPLAINED

WWHAT IS AB 116?

AB 116 is an assembly bill passed in the 2021 Nevada Legislature. It states that certain traffic violations in Nevada will become civil infractions instead of misdemeanors.

The changes brought forth by AB 116 went into effect on 1/01/2023.

WHAT ARE MY PAYMENT OPTIONS FOR CIVIL PENALTIES?

Payment options include:

  • Paying your penalty in full.
  • Setting up a Payment Plan.
  • Community Service.

Failure to respond to the civil citation within 90 days or failure to complete payment will result in your account being referred to collections, the suspension of your driver’s license, and the appropriate demerit points will be referred to the Nevada Department of Motor Vehicles.

LEARN THE DIFFERENCE BETWEEN:

A Criminal Misdemeanor:

A criminal misdemeanor is an offense that is punishable generally by no more than 6 months incarceration and/or a $1,000 fine (NRS 193.120).

A Civil Infraction:

A civil infraction is NOT a criminal offense, and it generally prescribes a minimum civil penalty of no more than $500 per violation, unless authorized by a specific statute (AB 116).

WHAT DO I DO IF I RECEIVE A CIVIL INFRACTION?

Beginning January 1, 2023, any person who receives a civil infraction within the City of Fallon must respond to the Fallon Municipal Court within 90 days after the date the citation is issued.

Uncontested Infractions:

If you do not wish to contest the determination that you are liable for the civil infraction as stated, you may pay your civil penalty by contacting the Fallon Municipal Court at 775-423-6244 to pay by phone, by mail or by visiting the Fallon Municipal Court at 55 West Williams Avenue, Fallon, NV 89406.

Contested Infractions:

If you wish to contest your civil infraction, you must still respond within 90 days to request a formal hearing. A bond must be posted prior to scheduling a hearing. Contact the Court Clerk at 775-423-6244 to discuss scheduling and bond payment options.
